1. Overview

This website is operated by But Poorly Drawn ("we," "us," "our"). By accessing or using our website and services (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Our store is hosted on Shopify Inc., which provides the e‑commerce platform that enables us to sell products and services to you.

2. Eligibility

You must be at least the age of majority in your jurisdiction to use this Service.

3. Our Product

We provide custom digital pet portraits in a deliberately exaggerated, humorous, and imperfect style. By placing an order, you acknowledge that:

  • The style is intentionally "ugly," stylized, and not realistic.

  • The style is non‑negotiable and cannot be changed per customer request.

4. Orders and Delivery

  • Orders are delivered digitally via email.

  • Standard delivery: by 11:59 PM the next calendar day after purchase (not a guaranteed 24‑hour window).

  • During December holidays, delivery may take up to 2 days.

  • If delivery fails, we will attempt to contact you up to two times by email.

  • If no response is received after two contact attempts, the order may be canceled and refunded.

  • If you provide an incorrect email address, it is your responsibility to contact us with the correct address. We assume delivery was successful unless notified.

  • Issues should be reported within 48 hours of delivery confirmation.

5. Revisions, Redraws, and Style

  • No style changes are accepted.

  • No redraws are offered. A new portrait requires a new order.

  • Revisions are only provided if:

    • We made an error against your original instructions, or

    • There is a spelling error in the pet’s name (this can be corrected before or after completion).

6. Satisfaction and Refunds

  • If you do not like your portrait, you may request a refund.

  • Orders canceled due to inappropriate content or policy violations are always refunded.

7. User‑Submitted Content

By uploading images ("User Content"), you confirm that:

  • You have permission to use and upload the images.

  • The image may depict your pet or someone else’s pet, including as a gift.

  • Celebrity pets are allowed.

  • We assume all uploads are made with permission or under good faith.

Prohibited Content

You may not upload content that includes:

  • Illegal activity

  • Harmful or abusive behavior

  • Hate, threats, or extreme offensive material

Nudity in images is allowed. Any upload containing illegal, harmful, or offensive content will result in immediate cancellation and refund.

We reserve the right to refuse or cancel orders based on uploaded content.

8. Ownership and Usage Rights

Your Rights

  • You own the final portrait you purchase.

  • You may use your purchased portrait for personal or commercial purposes, including:

    • Social media

    • Advertising

    • Logos

    • Merchandise

Our Rights

  • We may use finished portrait artwork for marketing, advertising, portfolio, or promotional purposes.

  • We may use portraits internally to improve our creative systems and workflows.

  • Original uploaded photos are never used publicly.

9. Automation and Internal Tools

  • Portraits may be created using automated systems and internal tools that are not customer‑facing.

  • All orders are reviewed and/or edited by a human before delivery.

  • Our process may evolve over time without changing the nature of the Service.

10. Bulk Orders, Resale, and Scraping

  • Bulk ordering is not permitted.

  • You may resell only the portrait you personally purchased.

  • Scraping, crawling, or automated data collection from our site is prohibited.

11. Behavior and Abuse

We may refuse service, cancel orders, or ban users who:

  • Engage in extreme rudeness, harassment, or abuse

  • Use profanity toward staff

  • Upload prohibited content

  • Attempt fraud or abuse of systems

12. Billing and Accuracy

You agree to provide accurate billing and contact information. We may cancel or limit suspicious or fraudulent orders.

13. Third‑Party Tools and Links

We are not responsible for third‑party tools or websites linked from our Service.

14. Intellectual Property

All website content, branding, and systems (excluding your purchased portrait) remain our property and may not be copied or reused without permission.

15. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind.

16. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages to the fullest extent allowed by law.

17. Indemnification

You agree to indemnify and hold us harmless from claims arising from your misuse of the Service or violation of these Terms.

We may terminate access at any time for violation of these Terms.
